Eligibility
You must be at least 18 years of age to book sessions or enter into these Terms on your own behalf. If you are under 18, a parent or legal guardian must agree to these Terms and provide consent on your behalf. We do not knowingly allow minors to register without such consent.
Services
We offer women's small-group personal training, lifestyle and nutrition coaching, body composition assessment, and related health and fitness services at our Lexington and Acton, Massachusetts studios. Session availability, pricing, and program offerings are subject to change at our discretion. We will make reasonable efforts to communicate changes in advance.
Trials, Memberships, and Payments
By claiming a trial or enrolling in a membership, you agree to pay all applicable fees as described at the time of purchase. Unless otherwise stated:
- Membership fees may recur on a periodic basis (e.g., monthly) and will continue until cancelled in accordance with these Terms.
- All fees are payable in advance and are processed through our third-party payment and CRM providers.
- You are responsible for keeping your payment information current.
Cancellations and Refunds
Cancellation and refund policies for trials, sessions, and memberships are provided at the time of purchase or enrollment. Unless otherwise specified, fees already paid are non-refundable. Results are not guaranteed. Each individual's results may vary. Testimonials and success stories on the Website reflect individual experiences and are not a promise of the results you will achieve.
Assumption of Risk
Personal training, strength and conditioning, and other fitness activities involve strenuous physical exertion that carries an inherent risk of injury. By participating in any session, program, or activity offered by us, you acknowledge and voluntarily assume all risks associated with such participation, including the risk of serious injury. You represent that you are in good physical condition and have no medical condition that would prevent safe participation. We recommend consulting a physician before beginning any new physical activity.
Release of Liability and Waiver
To the fullest extent permitted by law, you agree to release, waive, and hold harmless The Fitter Female, its owners, trainers, employees, and affiliates from any and all claims, liabilities, damages, or expenses arising out of or related to your participation in our sessions, programs, or use of our facilities, including injuries caused by ordinary negligence. A separate written waiver and release of liability may be required before participation, and these Terms do not replace any such document.
Code of Conduct
You agree to conduct yourself respectfully and safely on our premises and during all activities. We reserve the right to refuse service, suspend, or terminate the membership of any participant who engages in unsafe, disruptive, harassing, or inappropriate behavior, or who violates studio rules, without refund.
Use of the Website
You agree to use the Website only for lawful purposes. You may not attempt to gain unauthorized access to any part of the Website, interfere with its operation, or use it to transmit harmful or unlawful content. By providing your contact information, you authorize The Fitter Female to contact you by phone or email regarding your trial, booking, membership, account, or other service-related matters. SMS messages are sent only if you separately opt in through an unchecked SMS consent checkbox on our forms.
Transactional and informational SMS messages may include appointment confirmations, schedule changes, reminders, and account alerts. Marketing and promotional SMS messages may include offers, promotions, events, and updates. Marketing SMS consent is not required as a condition of purchase. Message frequency varies. You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a confirmation message and you will no longer receive SMS messages from us. Carriers are not liable for delayed or undelivered messages.
